( February 21, 2014, Colombo, Sri Lanka Guardian) A five-judge bench of the Supreme Court today quashed the Court of Appeal order, which held that the Parliament Select Committee (PSC) decision to impeach the then Chief Justice Shirani Bandaranayaka was null and void.
The bench comprising Justice Saleem Marsoof, Chandra Ekanayake, Sathya Hettige, Eva Wanasundara and Rohini Marasinghe held that the Court of Appeal had no jurisdiction to pronounce upon the decision of parliament.
The Judgment had held that the PSC was an organ of parliament and therefore the Court of Appeal, despite enjoying exclusive writ jurisdiction, such jurisdiction did not extend to parliament.
Earlier the Court of Appeal, headed by Justice Sriskandarajah held that the PSC decision to impeach the Chief Justice was null and void.
