Resolution passed at the special General meeting of the Kegalle Lawyers Association


( December 11, 2012, Kegalle, Sri Lanka Guardian) The following resolutions were unanimously passed at the Special General Meeting held at the Law Library on ;

1.In taking into consideration the unconstitutional, bias and unfair  manner in which the Parliament Select Committee appointed to investigate in to impeachment motion against Her Ladyship Chief Justice Shirani Bandaranayake, conducted its proceedings, it was obvious that the Rules of Natural Justice were blankly violated, and the entire proceedings were tainted with bias and injustice.

Hence it was unanimously resolved to seek immediate intervention of the United Nations Organization, the United Nations High Commission for Human Rights Asian Human Rights Committee, the Commonwealth Secretariat Commonwealth Magistrates and Judges Association  to stay the proceedings further and seek assistance to hold an impartial and a fair inquiry keeping in line with the international standers.

It was also resolved to seek the assistance of the International Bar Association, the Commonwealth Bar Association and the Law Asia to assist the Bar Association of Sri Lanka in making representations to the above international organizations.

Further in order to move in this matter a steering committee be appointed and the said committee shall have all authority to take whatever the steps necessary in this endeavor. The committee should be headed by Mr.        and the rest  of the members should be selected by Mr.   at his wish.

2.An action should be instituted for a mandate in the nature of a writ of certiorari and prohibition against the finding of the aforesaid select committee and to restrain the Parliament from proceeding further with the same.

For this purpose a committee be appointed headed by Mr. Geoffrey Alagaratnam PC to institute necessary action and the committee should have all authority to institute action on behalf of the Bar Association of Sri Lanka, to appoint Attorneys-At-Law and retain counsel if the committee so desires. Further Mr. Alagaratnam  PC should have all the authority to nominate and appoint the rest of the members of the committee.

3.In achieving the above task the President and the Secretary of the Sri Lanka Bar Association should assist the chairpersons of the above committees and should sign all document required for that purpose including proxy or proxies.
