Democracy or Anti Terrorism?

( June 05, 2012, Melbourne, Sri Lanka Guardian ) I write in response to the Sri Lanka Guardian article ‘Sri Lanka at Crossroads Struggle for Democracy is the Way Ahead’ by Dr. Laksiri Fernando.

The question as to whether the ‘Sri Lankan war was Anti-Tamil or Anti-Terrorism?’ rises again in my mind. The cause is often more difficult to quantify in objectively measurable terms but the effects are more quantifiable. As per the laws of nature – effects equal cause if both were expressed in objectively measurable forms.

When I instituted Legal Action against Senior Australian Administrators, some White Australian colleagues stated that they also had gone through similar injury and damage and hence rejected my claim of racism being the cause. Likewise Sinhalese and their Government about the war being ethnicity based. Dr. Laksiri Fernando himself states ‘But no country believed that terrorism was the only problem behind the conflict in Sri Lanka……. Sri Lanka has again come to cross roads on the ethnic front as well.’

One who considers general inefficiency and negligence as the main problem would not have enough focus to see through the ethnic problem. One who focuses through the ethnic problem would work towards democracy faster than the one who sees the main problem being one of terrorism. If Terrorism was the main problem – then Tamils of Sri Lanka are indeed much cleverer in warfare than all Sri Lankans put together as a country. This is also the reason why Tamils keep claiming Separate State. If Terrorism was the main problem – then the matter ought to have gone international when majority race/JVP rebelled. Given that that did not happen – one would conclude that Tamil rebels were cleverer than the Government itself or that the Government covered up in the case of JVP whilst exposing LTTE. The latter confirms that ethnicity was the reason for the war.

Similarly, at the economic front, Tamils of Sri Lanka, taken as a whole are demonstrating greater affordability and higher standards of living than is reported about the Common Sri Lankan. This to me, is largely due to Tamil culture of helping their families. It is built into our Laws of Thesawalamai including through the system of dowry.

The mental separation from the Sinhalese Government seems to have been economically progressive for Tamils of Sri Lanka. On the side of the Sinhalese, if they also accept that the war was primarily due to ethnic divide – they also would work towards Equal Opportunity and Merit based distribution of benefits. If not – the hierarchical system would continue to show but without a deep root to sustain its vertical growth.

Dr. Laksiri Fernando states ‘Priority is given for tamashas, but not for actual projects.’ This is often the case when unearned status is shown - towards taking benefits from wider world. They actually become handouts. This is happening not only in Sri Lanka at Government level but also amongst the welfare recipients within the Diaspora. As stated in an email message entitled ‘CAN AUSTRALIA SURVIVE GIVEN THE FOLLOWING?’, from a member of the Diaspora (Appendix 1) ‘The folks who are paying for the free stuff want the free stuff to stop, and the folks who are getting the free stuff want even more free stuff on top of the free stuff they are already getting’

The effects of the ‘excess’ welfare status flowing through as excess welfare monies - are the tamashas/parties. There is little left to even maintain the values developed through the old vertical system, leave alone add to them where democracy is not yet the trunk route.

It was against such ‘tamasha’/ partying tendencies that I have instituted legal action against members of my family through whom I invested in the values of Thesawalamai but who failed to uphold my investments. Like senior Australian Administrators, these members have hired legal practitioners including barrister to have me legally exiled from the Courts of New South Wales by using my previous actions against senior Administrators which were as per my belief about the level of my professional work. The gap between the Vice Chancellor of the University of New South Wales and the highest qualified in this Diaspora group – is that false status resulting in Tamashas. Likewise – the gap between the actual Democratic status of the President of USA and the President of Sri Lanka - is the level of ‘Aid Tamashas’ within the Sri Lankan Government circles.

The passage below from a recent affidavit of mine would, I believe show why I considered the effects of my Australian experience to be due to Race. One who is yet to invest in racial equality more than in the vertical system (as was the case with the Vice Chancellor as well as Prime Minister Howard back then) – would naturally ‘see’ it as a common problem to be addressed by use of their subjective powers. Those who use authority before objectively measurable outcomes are still using the vertical autocratic system. This is not wrong. But to state otherwise is wrong – especially in an Equal Opportunity Court / Environment.

‘I affirm that my complaints were based on the fact that I was considered an outstanding performer at the University of NSW for which I produced objective evidence and yet I was persecuted by Central Administrators who were above me in positions. Through direct experience through the avenues available to me I looked for a reason and given that there were no rules that directly covered this conduct of theirs applicable along the horizontal plane of Objective outcomes, I surfaced my ownership investment in the respective institutions and the positions held by me in my institutions, parallel to the officers who were seeking to dismiss me, including through negligence of their duties as per my belief. I believe that such surfacing effectively produces outcomes from disintegrated subjective powers and brings us to an even plane on which we show a wholesome picture of the two sides of the past. I believe that in this picture the portion that represents the subjective powers is also the consolidated common form in which we carry previous memories – which I feel is the root cause of actions. This root of consolidated memories I believe becomes the natural trait, quality / Kunam in Tamil of the person and when occupied by persons of such quality, naturally and with least conscious effort – the positions so occupied also take on those qualities / Kunam. This I believe needs the opposites to bring the objective plane and therefore Democracy to the level of the higher worker on that subject matter.

On that basis, I found that Racial Discrimination Act 1975 best fitted my experience and hence I complained through that Act – first against the Administration of the University of NSW and then against all those to whom I appealed but failed to receive engagement as per my interpretation of their position responsibilities. Hence the above complaints on the basis of my belief as to reason/root cause and objective evidence as to what happened through which all involved could identify whether the Respondents’ actions were merit based and mine were not – and v.v. I believe that it is the right of every Australian to communicate as an Equal to the person holding the ‘other’ side of the position taken by the citizen and as an Equal I believe I have the responsibility to produce the picture of my experience independent of the other side. I believe that those who are not able to do this do not qualify to represent themselves in Court and therefore qualify as frivolous litigants. I affirm my belief that to the extent my genuine work is not included by the legal system – including through usage as case law – it goes as contribution direct to social justice system to the extent of my ownership feelings. I believe that the way to test whether my work has been taken on the plane of Equal Opportunity is - the equality looks of the two sides’ evidence – combined objective and subjective evidence.’

As a result of knowing the true limits of the investment made by Senior Australian Administrators of my time, in Racial Equality – I have shifted my investments away from Public Institutions that show ‘status hoarding’ through lip service to Equal Opportunity . Hence I now work to invest in the ‘social justice’ system which I believe is also a core purpose for which the media exists. Sri Lanka Guardian has been for me a strong medium towards this.

My question to Dr. Laksiri Fernando is ‘How would you as a member of minority race in Australia, compare Australian leadership in Public Administration and Management – with that of Sri Lankan leadership in Public Service?’

If Dr. Laksiri Fernando is thinking more as a Sri Lankan than as an Australian then Dr. Laksiri is bypassing Country level to invest in Global standards which would then contribute more to theory than to real solutions.

Terrorism is more easily managed through project basis than Racism. Projects show objectively measurable beginning and end. Programs don’t. They are more towards bringing our minds together towards which benefits are lifted to the higher level – into the confidential chambers of Responsibility to Protect and Harmonize.

Appendix 1

CAN AUSTRALIA SURVIVE GIVEN THE FOLLOWING?

The folks who are getting free stuff, don't like the folks who are paying for the free stuff, because the folks who are paying for the free stuff can no longer afford to pay for both the free stuff and their own stuff.
The folks who are paying for the free stuff want the free stuff to stop, and the folks who are getting the free stuff want even more free stuff on top of the free stuff they are already getting!

Now... The people who are forcing the people to pay for the free stuff have told the people who are RECEIVING the free stuff, that the people who are PAYING for the free stuff, are being mean, prejudiced, and racist.

So... The people who are GETTING the free stuff have been convinced they need to hate the people who are paying for the free stuff by the people who are forcing some people to pay for their free stuff, and giving them the free stuff in the first place.

We have let the free stuff giving go on for so long that there are now more people getting free stuff than paying for the free stuff.

Now understand this: all great democracies have committed financial suicide somewhere between 200 and 250 years after being founded. The reason? The voters figured out they could vote themselves money from the treasury by electing people who promised to give them money from the treasury in exchange for electing them. Thomas Jefferson said it best: “Democracy will cease to exist when you take away from those who are willing to work and give to those who would not”.

The number of people now getting free stuff outnumbers the people paying for the free stuff. We have one chance to change that at the next election in 2013 will we? Failure to change that spells the end of Australia, as we know it.
