(June 20, Chennai, Sri Lanka Guardian) State government today was not able to take a categorical stand on the counter petition filed by Janata Party president Subramanian Swamy against the release of Rajiv Gandhi murder convict Nalini who was undergoing life sentence at Vellore prison.
It may be recalled Nalini has moved the Madras High Court for release as she had already spent 17 years of prison term. Swamy in a counter petition challenged her move in the High Court.
When the case was taken up for hearing by the Judge Nagamuthu, Nalini counsels Duraisamy and Elangovan opposed the counter petition of Swamy and requested the Judge to reject the same.
However, the government lawyers when asked if they would present their replies to Nalini petition replied that they have not done it so far and yet to decide on the stand to be taken on Swamy’s counter petition.
They neither supported nor opposed the move of Swamy in the High Court, the lawyers said. When asked if they were willing to register their neutral stand on the issue, the lawyers informed the advocate general would present before the Judge to present the views of the government.
Senior advocate Rajagopal appearing for Swamy said the government would not oppose his client’s petition for he had taken the same position as that of the government.
To this argument, Nalini’s lawyers urged the government to firmly explain their stand on the release petition of murder convict.
The court adjourned the hearing for the afternoon during which arguments on whether to combine the Swamy’s petition with that of Nalini’s would be taken up.
